Welcome to Eureka Concierge. These Terms and Conditions govern your access to and use of EurekaConcierge.com and any downloadable tours, guides, maps, articles, recommendations, and related products or services offered by Eureka Concierge.

By visiting our website, making a purchase, downloading a product, or using one of our guides, you agree to these Terms and Conditions. If you do not agree, please do not use the website or purchase our products.

1. About Eureka Concierge

Eureka Concierge creates downloadable, self-guided adventures featuring the history, art, attractions, businesses, scenery, food, entertainment, and culture of Eureka Springs and the surrounding area.

Eureka Concierge does not operate the businesses, attractions, public spaces, roads, trails, or other locations featured in its guides.

2. Eligibility

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to make a purchase.

Participation in activities involving alcoholic beverages is limited to individuals who meet the applicable legal drinking-age requirements. Businesses may require identification and may refuse service at their discretion.

3. Purchases and Payment

Prices are listed in U.S. dollars. The complete price, including any applicable taxes or additional charges, will be shown before you submit payment.

By making a purchase, you represent that:

• The information you provide is accurate and complete.

• You are authorized to use the selected payment method.

• You authorize our payment provider to charge the amount shown at checkout.

We reserve the right to refuse or cancel an order because of suspected fraud, unauthorized activity, pricing or technical errors, product unavailability, or other legitimate business reasons. If we cancel an order after payment has been processed, the amount paid will be refunded.

4. Digital Delivery

Eureka Concierge products are delivered electronically through a download link, website access, email, or another digital-delivery method identified at checkout.

You are responsible for:

• Providing an accurate email address.

• Having a compatible device and software.

• Maintaining adequate internet access for downloading the product.

• Downloading and saving your purchase while access remains available.

5. Refund Policy

Because Eureka Concierge products are digital and may be accessed immediately, purchases are final once a product has been delivered, accessed, or downloaded.

If you make an accidental duplicate purchase, receive the wrong product, or experience a technical problem that prevents access, contact us within seven days of purchase. We will make reasonable efforts to provide a working replacement or, when appropriate, issue a refund.

Nothing in this policy limits any refund or cancellation right that cannot legally be waived.

6. Personal-Use License

Your purchase gives you a limited, nonexclusive, nontransferable license to use the guide for your personal, noncommercial use and to share it with members of your immediate traveling party during the adventure.

Purchasing a guide does not transfer ownership of its content or intellectual-property rights.

Unless Eureka Concierge gives prior written permission, you may not:

• Resell, redistribute, publish, upload, or publicly display a guide.

• Share copies with people outside your immediate traveling party.

• Copy substantial portions of a guide.

• Remove copyright, trademark, or ownership notices.

• Modify or use the content to create another tour, guide, product, or commercial service.

• Use automated systems to scrape, collect, or reproduce website or guide content.

7. Local Conditions and Changing Information

Eureka Concierge makes reasonable efforts to provide useful and accurate information. However, local conditions can change without notice.

Business hours, prices, menus, admission fees, promotions, routes, parking, transportation, accessibility, construction, weather conditions, trail conditions, public access, and attraction availability may change after a guide is published.

Before visiting a location, you should confirm current hours, prices, restrictions, accessibility, and availability directly with the business, attraction, or property operator.

A location’s inclusion in a guide does not guarantee that it will be open, accessible, safe, or suitable for every participant on the day of your visit.

8. Self-Guided Activities and Personal Responsibility

Eureka Concierge tours are self-guided. No guide, escort, transportation, supervision, security, or emergency assistance is included unless expressly stated.

Some adventures may involve:

• Walking on steep, narrow, uneven, or slippery surfaces.

• Stairs, hills, bridges, trails, street crossings, or limited sidewalks.

• Driving on winding, narrow, or unfamiliar roads.

• Changing weather or outdoor conditions.

• Locations with limited accessibility.

• Food, beverages, or alcoholic drinks purchased independently from local businesses.

You are responsible for evaluating your health, mobility, experience, surroundings, weather, road conditions, and personal safety before and during an adventure. Wear appropriate footwear, supervise children, respect posted signs, remain in permitted public areas, and follow all laws and property rules.

In an emergency, contact 911 or the appropriate local authority.

9. Driving Safety

Do not read, operate, or interact with a digital guide while driving. A passenger should navigate, or the driver should stop in a safe and lawful location before viewing the guide.

Always follow traffic laws, posted warnings, road closures, parking restrictions, and directions from public officials. Eureka Concierge is not responsible for citations, vehicle damage, accidents, missed turns, road conditions, or decisions made while traveling.

10. Alcohol-Related Adventures

Alcohol is not included with the purchase of a guide unless expressly stated. Each participating establishment independently determines its hours, prices, availability, admission requirements, and service policies.

Participants must drink responsibly. Never drink and drive. Use a designated driver, walking route, taxi, or rideshare service when appropriate.

Eureka Concierge is not responsible for the service, refusal of service, quality, availability, or effects of alcoholic beverages purchased from another business.

11. Third-Party Businesses and Websites

Guides and website pages may mention or link to independently owned businesses, attractions, reservation services, social-media pages, or other third parties.

Eureka Concierge does not own or control these third parties and is not responsible for their:

• Products, services, prices, availability, or representations.

• Websites, reservations, cancellations, or refund policies.

• Safety, accessibility, conduct, or customer service.

• Privacy, security, or data-collection practices.

Any transaction or interaction with a third party is solely between you and that third party.

12. Sponsored and Paid Placements

Some business mentions, featured listings, links, discounts, or recommendations may be sponsored or paid placements. Where applicable, these relationships will be identified in a manner appropriate to the content.

Sponsorship does not make Eureka Concierge responsible for the participating business or guarantee the quality, availability, or suitability of its products or services.

13. Promotions and Discounts

Discounts, special offers, and promotional codes may be subject to additional restrictions, expiration dates, availability limits, or participating-business requirements.

Offers may not be combined unless expressly stated. Third-party businesses are responsible for honoring promotions they independently provide.

14. Historical Information, Legends, and Local Lore

Eureka Concierge guides may include historical accounts, local traditions, folklore, legends, ghost stories, and interpretations drawn from available sources.

We strive for factual accuracy but do not guarantee that every historical account is complete, undisputed, or free from conflicting interpretations. Folklore, legends, and supernatural stories are presented for cultural, historical, or entertainment purposes and should not be understood as verified fact unless expressly identified as such. Information is indeed for entertainment.

15. Intellectual Property

The website and downloadable products—including their writing, photographs, graphics, maps, layouts, branding, logos, and original tour concepts—are owned by or licensed to Eureka Concierge and are protected by applicable intellectual-property laws.

“Eureka Concierge” and associated names, logos, designs, and slogans may not be used without prior written permission.

16. Acceptable Website Use

You agree not to:

• Use the website for unlawful, fraudulent, or harmful purposes.

• Attempt to gain unauthorized access to the website or another user’s information.

• Interfere with the website’s operation or security.

• Introduce malicious software or harmful code.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

Eureka Concierge does not guarantee uninterrupted access, error-free downloads, particular results, or the continued availability of any route, location, attraction, business, promotion, or experience.

Nothing in a guide constitutes medical, legal, safety, transportation, or other professional advice.

18. Limitation of Liability

To the fullest extent permitted by law, Eureka Concierge will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, a downloadable product, a featured location, or a third-party business.

Eureka Concierge is not responsible for personal injury, illness, allergic reaction, property loss, theft, vehicle damage, business closure, weather, road or trail conditions, acts of third parties, or decisions made by participants.

If Eureka Concierge is found liable for a claim relating to a purchased product, our total liability will not exceed the amount you paid for the product giving rise to that claim.

These limitations do not apply where prohibited by law.

19. Privacy

Our collection and use of personal information are governed by the Eureka Concierge Privacy Policy. By using the website, you acknowledge that you have had an opportunity to review that policy.

20. Changes to Products or Terms

We may update, correct, revise, or discontinue website content and downloadable products. Updated editions may differ from previously purchased editions.

We may also update these Terms and Conditions. Revised terms will be posted on this page with a new effective date. Changes will apply prospectively unless otherwise permitted by law.

21. Governing Law

These Terms and Conditions are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.

Before filing a legal claim, you and Eureka Concierge agree to make a reasonable good-faith effort to resolve the dispute informally. Any legal proceeding that cannot be resolved informally shall be brought in a state or federal court with jurisdiction over Carroll County, Arkansas, unless applicable law requires otherwise.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be interpreted or modified only to the extent necessary to make it enforceable.

23. Entire Agreement

These Terms and Conditions, together with the Privacy Policy and any specific terms displayed at checkout, constitute the agreement between you and Eureka Concierge concerning your use of the website and purchased products.
